Welcome to Seat Smart - Classivio ("Company", "we", "our", "us")! These Terms of Service ("Terms", "Terms of Service") govern your use of our website and software application Seat Smart - Classivio (collectively, the "Service").
BY ACCESSING, BROWSING, OR USING OUR SERVICE IN ANY WAY, INCLUDING BUT NOT LIMITED TO CREATING AN ACCOUNT, PURCHASING TOKENS, OR CREATING SEATING PLANS, YOU AUTOMATICALLY AGREE TO BE BOUND BY THESE TERMS OF SERVICE. Your use of the Service constitutes your acceptance of these Terms.
If you do not agree to these Terms, you must immediately stop using the Service. Continued use of the Service after any changes to these Terms constitutes acceptance of the revised Terms.
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.
2 Definitions
SERVICE
means the Seat Smart - Classivio website and software application operated by the Company.

means the individual accessing or using the Service, or the Educational Institution, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
3 Use of Service
Seat Smart - Classivio provides classroom seating plan management tools for educational professionals. Our Service allows users to create, manage, and optimize classroom seating arrangements based on various factors including student relationships, skill levels, and special needs.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.
You must not transmit any worms or viruses or any code of a destructive nature. Any breach or violation of these Terms may result in immediate termination of your account.
4 Data Privacy & Security
We take data privacy seriously, especially when it comes to student information. Our Service complies with relevant data protection regulations including GDPR, FERPA, COPPA, and other applicable laws depending on your jurisdiction.
Educational Institutions are responsible for obtaining appropriate consent from parents/guardians when using our Service to process student data for children under applicable age restrictions.
We implement appropriate technical and organizational measures to protect your personal data. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

6 Prohibited Uses
You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
Legal Compliance
In any way that violates any applicable national or international law or regulation.
Spam
To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
Impersonation
To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
Interference
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm the Company or users of the Service.
Harmful Content
For any purpose that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
